Notice of Default or Foreclosure Notice is a notification given to a borrower stating that he or she has not made their mortgage payments by the predetermined deadline. It is the first legal document you will receive and it marks the beginning of the pre-foreclosure process. It dictates that if the money owed (plus an additional legal fee) is not paid in a given time, the lender may choose to foreclose the borrower's property. Any other people whom may be affected by the foreclosure may also receive a copy of the notification.

 

The Notice of Default (NOD) is the initial document (non-judicial) filed by a trustee and the filing starts the foreclosure process and both LIS and NOD are part of the PRE-foreclosure process.  The Notice of Default is recorded where the property is located and is the first step that a lender takes in the foreclosure process. Once the Notice of Default has been recorded the lender must wait 90 days before continuing with the foreclosure process.
